RELEASE AND WAIVER OF LIABILITY FOR MINOR PARTICIPANTS
PLEASE READ CAREFULLY. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS PURSUANT TO COLORADO LAW (C.R.S. § 13-22-107).
I, the undersigned, am the parent or legal guardian of the minor child(ren) listed below. I wish for my child(ren) to participate in the mobile sensory and sand play activities offered by The Colorado Sandbox, LLC (hereafter "The Company").
1. Assumption of Risk: I explicitly acknowledge and understand that participation in sand play, climbing into a mobile trailer, and operating toy mechanical equipment involves inherent minor risks, including but not limited to: slips, trips, falls, minor scrapes, eye irritation from sand, accidental ingestion of sand, and interactions with other children. I freely and voluntarily assume all such risks on behalf of my minor child, both known and unknown.
2. Release and Hold Harmless: Pursuant to Colorado Revised Statutes § 13-22-107, I hereby release, waive, and forever discharge The Colorado Sandbox, LLC, its owners, officers, employees, and agents from any and all liability, claims, demands, or causes of action arising out of ordinary negligence resulting in personal injury, disability, property damage, or medical expense during our participation in this activity.
3. Material & Medical Attestation: I certify that my child does not have any physical or medical conditions (such as severe respiratory conditions or severe sand/dust allergies) that would make participation unsafe. I understand that The Company utilizes premium, 100% dust-free aragonite ocean sand and sanitizes the environment using child-safe botanical solutions and UVC light systems; however, I assume responsibility for any unexpected allergic or physical reactions.
4. Media Release (Optional - Strike if preferred): I hereby grant The Company permission to use photographs or video footage taken of my child during the event for promotional, social media, and website marketing materials without compensation.
5. Governing Law: This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Colorado. If any portion of this waiver is deemed invalid by a court of law, the remaining provisions shall remain in full force and effect.
By signing below, I acknowledge that I have read this document in its entirety, understand that I am waiving certain legal rights on behalf of myself and my minor child, and sign it voluntarily.
